The political atmosphere is already charged for fun fare over the ongoing celebration on the streets of Owerri , starting from the Okigwe road Secretariat of the Peoples Democratic Party (PDP) ; as the people jubilated over the decision of the Election Petitions Tribunal which on Saturday , 21st September 2019 , in Abuja , upheld the election of His Excellency , Rt. Hon. Emeka Ihedioha as the authentic and duly elected governor of lmo state in the March 9th guber contest in the state.
The Abuja correspondent of 4thestatereporters.com gathered that , the election of governor Emeka Ihedioha was confirmed by a majority decision taken by the panel of Judges in the Governorship Election Petitions Tribunal which was relocated from its original Owerri jurisdiction to Abuja , where it ruled that the election of Chief Emeka Ihedioha of the Peoples Democratic Party met the 2/3 spread of the electoral law to be declared winner .
Earlier before the judgment , parties to the law suit and candidates of the three major
opposition parties Ugwumba Uche Nwosu (AA) , Hope Uzodinma (APC) and Ifeanyi Ararume (APGA) whose Petitions were separately struck out for by the Election Petitions Tribunal for lacking merits and substantiated evidences ; had early called for a total cancellation of the election , re -run of the election and declaration of the APC candidate winner of the election .
The Tribunal had , in its early ruling , struck out the petition of Sen. Ifeanyi Ararume of APGA, as it maintained that he didn’t prove beyond reasonable doubt that Ihedioha who is the second respondent in the case did not meet the required spread to be declared winner .
While Nwosu’s application for judgement on admitted fact was dismissed on the basis that declaratory reliefs are not granted on admitted facts.
While delivering its judgement , the tribunal which delivered its judgement in Abuja , dismissed all the grounds of the petition , saying that the petitioners in their separate applications did not prove them beyond reasonable doubts as required by law.
In other words ; ” There is no shred of cogent evidence in proof of their allegations as required by relevant laws . Therefore , the Petitions were dismissed in its entirety for lack of merit .
Meanwhile , the governorship candidate of Action Alliance and former governor’s son in-law , Ugwumba Uche Nwosu has ever since rejected the tribunal judgement that favoured Chief Emeka Ihedioha of the Peoples Democratic Party ; as he heads to Appeal Court .
